Terms and Conditions

In order to use the "Orange Cones. No Phones." e-Toolkit and its contents (the "e-Toolkit"), you must read, understand and agree to the following terms and conditions. Please read these provisions carefully, and feel free to contact the Sponsors for an explanation of any terms and conditions you do not understand. By checking the "I Accept" box, you will signify acceptance of these terms and conditions.

The Sponsors of this Toolkit are Transurban, Fluor Enterprises and AAA Mid-Atlantic and their respective affiliates, related companies and contractors (hereinafter the "Sponsors").

1. The purpose of this e-Toolkit is to raise awareness about the dangers of distracted driving while driving through active construction zones in the Washington, D.C. metropolitan area (hereinafter the "Campaign"). This e-Toolkit is restricted to use by employers in the Northern Virginia region (each hereinafter referred to as the "Employer").
2. The Employer may use, copy and distribute the e-Toolkit to all employees and contractors of the Employer. The e-Toolkit is to be used by the Employer solely for the purpose of educating its employees and contractors about the Campaign, and is not to be used or distributed, by the Employer or its employees, to any third-party outside of the company.
3. The Employer agrees that the e-Toolkit may only be posted on the Employer's internal website or worksite, which can only be accessed by the Employer's employees and contractors, and not any third parties outside of the company. The Employer agrees to take all necessary steps to prevent such access by third parties and agrees not to post the e-Toolkit on its or any external website or any page it may have on an electronic social network. The Employer, however, is permitted to acknowledge or describe its participation in the Campaign on its external website, in press releases, in its marketing materials or in other materials produced by the Employer.
4. The Employer agrees to revise, add or delete certain components of the e-Toolkit only as it relates to customizing the e-Toolkit for its organization. Any customization should not alter the facts or content as it relates to definitions and statistics.
5. The Employer agrees that the e-Toolkit is the exclusive property of the Sponsors, and shall acknowledge this ownership at all times.
6. The Sponsors reserve the right to terminate your use of the e-Toolkit, with notice to you, any time you breach any of these terms and conditions. The Employer shall be liable for any and all damages suffered by the Sponsors should the Employer breach any of these terms and conditions.
